These Terms of Use are a binding contract that governs the use of the Fujiya website and contains other important provisions. Each time you access the Fujiya website you acknowledge that you have read, understood, and agreed to these terms of use. If you do not agree with these Terms of Use, you may not access or use the Fujiya website.

This website is designed for and intended for use by adults. If you are under the age of majority in the jurisdiction where you reside, you may use this website only with involvement of a parent or guardian. If you are a parent or legal guardian, you must supervise the use of the website by children, minors, and others under your care. You agree to be responsible for their use of the website, whether or not the use if in conjunction with your personal account. You are fully responsible for the online conduct of the minor and any purchases made by the authorized minor. You may not use this website if you breach these Terms of Use, or if your permission to use the website has been suspended or terminated by Fujiya.

Your Information
You will ensure that you provide accurate and current information about yourself as requested and to promptly update such information as necessary to maintain its accuracy. You agree to ensure your account information (including your legal name, residential address, email address), payment information (including your credit card numbers, expiration dates and CVV), and transaction-related information, is true, accurate, current, and complete. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, Fujiya or any other person may incur as a result of your submission of any false, incorrect, or incomplete information or your failure to promptly update your account information and payment information if they change.

Payment

We accept VISA, MasterCard, American Express, JCB, and Discover credit cards. All payments are processed through Moneris Checkout, which complies with the Payment Card Industry Data Security Standards (PCI DSS). When you place your order, your method of payment will be charged.

 

You agree to pay for the items at the prices stated at the time you submitted the order, along with any applicable delivery fees and taxes.

We reserve the right at any time after receipt of your order to accept or decline or cancel your order (in whole or in part) for any reason. Your order is not accepted until the day of your pickup/delivery order. We may contact you for additional information before accepting any order. If we cancel all or part of your order, we will issue a refund to your credit card account in the amount charged for the cancelled portion (if you have already been charged) or you will not be charged for the cancelled portion. Some situations that may cause your order to be cancelled in part or in full are:

• Limitations on the product quantities available for purchase 

• Inaccuracies or errors in the published product or pricing information

If your card is declined by your card provider, Fujiya will contact you to discuss alternative payment options. Additional fees may be incurred if payment is declined and alternative payment arrangements are required. If your card is rejected by the card issuer and other payment arrangements are unsuccessful, your order will not be prepared for pick up or delivery. Fujiya will have no obligation to fulfill your order and you will be advised by email that your order will be rejected.

You agree to provide ideally 24 hours notice by telephone for any order cancellation or modification. We must confirm your order cancellation and it is up to Fujiya's discretion to accept the cancellation. If you do not cancel and fail to pick up your order, you will still be charged the full amount. If you wish to modify your order, you will be refunded or charged again for the items removed or added.

Availability of Items

The purchase of products is subject to availability. In the event that Fujiya advises that the products are no longer available, Fujiya does not have any obligation to provide such products and you will have no obligation to pay Fujiya for such products.

Taxes

Items on the website do not include taxes. When you place an order, the taxes will be shown in your Order Summary during checkout.

Delivery Rates

​

Delivery orders are subject to a delivery fee based on delivery zone and minimum subtotal amount. To determine your delivery zone, search your address in Google Maps. The zone will automatically be calculated at checkout. For the zones, fees and delivery minimums, see the bottom of this page.

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

Store Return & Exchange Policy

Returns and exchanges are accepted within 14 days with the following:

• Item to be returned, unopened & in re-sellable condition

• Original Fujiya receipt

• Card receipt (if applicable)

No returns accepted on daily prepared food. Returns go back on original method of payment.
